Right of withdrawal for customers (consumers)

You are entitled to revoke your contractual agreement in writing (e.g. mail, fax, email) within 14 days without specifying reasons. If the respective product has been delivered to you before the end of the period, you may also revoke by returning the product .The time limit begins with the receipt of this instruction in text form, however not before the delivery of the product (not before the first partial delivery in cases of recurring deliveries of similar goods) and not before the fulfillment of our information obligations as per Art. 246 Sec. 2 in conjunction with Sec. 1 (1) and (2) German Introductory Act to the Civil Code (EGBGB) as well as our obligations under Sec. 312g (1) 1. German Civil Code (BGB) in conjunction with Art. 246 Sec. 3 EGBGB. Dispatching the revocation or the product on time is sufficient to comply with the revocation period. Consequences of Withdrawl

In the case of an effective revocation, both parties must mutually return the received contractual services including derived benefits (e.g. interest). If you are wholly or partly unable to return the received contractual service or can only return it in a deteriorated condition, you have to compensate the lost value. You only have to compensate the lost value caused by decline if the decline is based on treatment of the product that exceeds the examination of the product’s characteristics and functions. The “examination of the product’s characteristics and functions” is equal to what is possible, usual, and appropriate if the respective product was offered in a retail shop. Products eligible for shipping by mail are to be sent back to us. You bear the usual costs for the shipment if the delivered product complies with the order and if the price of the returned product does not exceed 40 Euro or if you have not paid the product or a contractual part payment at the time of revocation. In all other cases the return of the product is free of charge. Products not eligible for shipping by mail will be picked up. Obligations to refund payments must be fulfilled within 30 days. The time limit begins for you with the sending of your revocation notice and for us with its receipt. Any obligation to return a payment has to be met within 30 days. The 30 days period begins with the dispatch of the revocation or the dispatch of the product and for us with the receipt of the product.

Exclusion of the right of withdrawal

There is no right of withdrawal if the respective contract concerns the delivery of a product that is produced according to the customer’s specifications or if the product is definitely designed to meet the customer’s personal needs or if the product is not suited to be returned because of its characteristics or because it might decay or because its expiry date might be passed.
